Article 4 – Delivery
Goods are shipped to the delivery address above by cargo. Made-to-order parts are dispatched after production within the lead time stated in the quote. In any case, delivery is made within 30 days of the order unless a longer period has been expressly agreed in writing.
The buyer should inspect the package on delivery and have a damage report drawn up by the carrier if it is damaged. If the seller cannot perform for reasons such as the goods becoming unavailable, it informs the buyer within 3 days and refunds the full amount within 14 days.
Article 5 – Made-to-order parts and files
Made-to-order parts are produced from the files and specifications supplied by the buyer. The buyer is responsible for the accuracy of the model, units, dimensions, material choice and fitness for the intended use, and warrants that they hold all intellectual property rights in the files and that production does not infringe third-party rights. The seller may refuse or cancel orders for weapons, weapon parts or any item whose manufacture or possession is unlawful. Files are used only to prepare the quote and produce the order and are not shared with third parties.
Unless stated otherwise in the quote, general tolerances of ISO 2768-m apply. Process-specific marks (layer lines, tool marks, burrs removed to a reasonable degree, slight colour differences) are not defects.
Article 6 – Right of withdrawal
For standard products sold on Eksenix Market, the buyer may withdraw from the contract within 14 days of delivery without giving any reason and without paying a penalty. Notice of withdrawal is sent to [email protected] or to the seller's address in writing or via the customer panel. The product must be returned within 10 days of the notice; the seller refunds the full price, including the delivery cost, within 14 days of receiving the notice, using the payment method used for the purchase.
Parts manufactured from a file, drawing, sample or specification supplied by the buyer (3D printing, CNC machining, laser cutting, press-brake bending and similar made-to-order work) are goods prepared in line with the consumer's wishes or personal needs. Under Article 15(1)(ç) of the Distance Contracts Regulation, the right of withdrawal does NOT apply to these goods. The buyer's rights for defective goods under Law No. 6502 are reserved.
Article 7 – Defective goods
If the goods are defective, the buyer may use the optional rights in Article 11 of Law No. 6502 (withdrawal from the contract, price reduction, free repair or replacement). Production defects must be reported with photographs to the seller's email address.
Article 8 – Personal data
Personal data is processed under the Privacy Notice published at https://eksenix.com.
Article 9 – Disputes
Consumers may apply to the Consumer Arbitration Committee or the Consumer Court within the monetary limits announced each year. For buyers acting for commercial or professional purposes, the provisions on consumers do not apply and Bursa courts and enforcement offices have jurisdiction.
Article 10 – Entry into force
The buyer confirms having read the pre-contractual information form and this contract and approved them electronically before payment. A copy is stored in the buyer's account and sent by email.
